Is there a setting somewhere that controls the default checkbox state for the mailing list (on the OnePageCheckout)? I'd like this to be checked by default.

There isn't a setting for that, and I'd have to wonder if that would not stand up to the "opt-in" rules of the CAN-SPAM act, since you would technically be asking them to "opt-out".

We should have a choice on our own to set it up as default though. As far as I know it is far within the rules.  The newsletter checkbox on every place I buy from is already checked. Should we ask for this to be quoted as a backend checkbox option for us to turn on/off?
